Courts and Child Custody Decisions
As if filing for divorce isn't difficult enough, deciding which type of custody to file for can be just as complicated. This is especially true if you intend to seek sole
child custody.
Depending on what state you reside in, judges may have different attitudes towards sole custody. In general, judges will do what is considered to be in the best interests of the child in question. If the court agrees that joint custody is both advantageous and achievable by both parties, judges prefer to award it. However, this is not always the case. In many families, one parent is not financially and/or physically capable of assuming sole physical custody of the child. In these types of cases, the other parents may be granted sole physical custody. Yet, this does not mean that the second parent cannot be eligible for joint legal custody which allows both parents to have an equal say in the child's upbringing, even if the child lives full-time with one parent.
