Guatemalan Mother Tries to Get Custody of Her Child

The case of a Guatemalan mother trying to reclaim her son has gone national this week as Encarnacion Bail Romero fights to win back her child.

The Missouri Supreme Court stepped in to hear the child custody case and eventually sided with the immigrant. In its ruling the court argued that the state did not uphold the laws when they terminated her parental rights and put her son up for adoption.

Although this is a positive step for Romero it does not automatically return her son back to her. The court ordered that the state go back and follow standard procedures in this case in a new trial to determine whether Romero's parental rights should be terminated. Ever since her release from federal prison for aggravated identity theft Romero has been fighting to get her son back. He is now living with adoptive parents Seth and Melinda Moser of Carthage. Romero's son is now four years old.
