Post Nuptial Agreements
Most people have heard about prenuptial agreements, which are signed before a couple is wed in order to protect each others' assets in the event of a divorce or separation. These are especially helpful for people who have unequal financial circumstances when they get married.
Not everyone, however, has heard of a postnuptial agreement. These are entered into anytime after the marriage, whether during good times or bad, with the same thought of protection in mind. Often, people will decide a postnuptial agreement is appropriate if one partner makes significantly more money than the other, or if relations become strained and the couple is considering separation or divorce. It can also be used as a Will, should one spouse die.
A postnuptial agreement can decide issues such as alimony, property division, etc, although it cannot waive child support obligations. These can often save thousands of dollars during a divorce proceeding.
