Domestic Partnerships

Since the state of New York does not allow same-sex couples to marry legally and has no specific recognition for these relationships, gay and lesbian couples have increasingly looked to a domestic partnership agreement for legal protection of assets, property and minor children. It should be understood, however, that domestic partnerships are not limited to same-sex couples; rather, any two adults may enter into a legally binding contract that delineates the sharing of assets, children and retirement funds as well as issues of medical care and the designation of a guardian should an individual become incapacitated.

An example could be an unmarried couple with substantial assets that could be lost should either party remarry. The domestic partnership agreement provides substantial legal protection and can help avoid disputes between immediate family members and the domestic partner in the event of illness or death.

In order to enter into a domestic partnership, the couple must register their relationship before the city clerk and attest their devotion to one another. Individuals who enter into Domestic Partnerships share a common domestic lifestyle, but they have not been joined in a traditional or common law marriage or a civil union.
