New York has state-mandated requirements that must be met before a divorce will be granted. First and foremost, in order to be granted a divorce at least one spouse must currently be a New York state resident for at least a year. Furthermore, in order to successfully file for divorce in New York, the couple must have legal grounds. If a couple does not have legal grounds to file for divorce, then they must legally separate for one year, after which they will be granted a divorce. A couple has legal grounds for divorce if any of the following circumstances are true:
- One or both spouses committed adultery
- One or both spouses committed abusive, cruel, or inhumane behavior
- One or both spouses has been incarcerated for three years or longer
- One spouse abandoned the other spouse for a continual period of one year or longer
- One or both spouses has refused to engage in marital relations for one year or longer
- Conversion of separation judgment (the couple is granted a divorce after living apart for a period of one year or longer as specified in the judgment)
